Rent is easy to split on paper. The messier questions arrive later: What happens when the electric bill spikes, a partner stays over four nights a week, or someone leaves with six months on the lease?

A roommate agreement puts those decisions in writing while everyone is still getting along. The copyable template here covers money, shared space, guests, damage, and the exit plan, with blanks you can adapt to your home.

Use the right agreement for your living setup

A roommate agreement is a contract among the people sharing the home. It is separate from the lease between renters and the landlord, as Ohio State Student Legal Services explains. It cannot permit a pet, extra occupant, sublet, or other activity that the lease prohibits.

Read the rent-liability language closely. Many joint leases use joint and several liability, which can make each signer responsible to the landlord for the full rent or other lease obligations. Your private rent split can document what one roommate owes another, but it does not reduce the landlord's rights under the lease. The K-State tenant handbook gives a clear example: the remaining renters can still owe the full rent when one roommate leaves.

If one renter is renting space to someone who is not on the lease, the relationship may be a subtenancy governed by state and local law. Ohio State's sublease guidance notes that the original renter can remain liable to the landlord and that many leases require written permission. A house-rules agreement alone is too thin for that setup.

A lease sits above two separate branches: a roommate agreement between co-renters and a landlord-approved sublease between an original renter and another resident.

Settle five choices before you fill in the form

The best agreement records a real conversation. It does not turn one person's preferences into a surprise rulebook. Put these five decisions on the table first:

  1. The money route: Set each person's exact rent, an internal due date before the landlord's deadline, the payment method, and who sends the final payment.
  2. The bill rule: Decide who holds each account, when bill images are shared, how fixed and usage-based charges are split, and who pays a final bill that arrives after move-out.
  3. The guest limit: Use both a consecutive-night limit and a monthly limit. Decide whether advance notice is enough or certain visits need everyone's approval.
  4. The damage and deposit rule: Record what each person contributed, how individual damage is documented, and how a departing roommate's share is handled before the landlord returns the deposit.
  5. The exit plan: Name the notice period, who searches for a replacement, the approval process, and when the departing roommate's payment duty ends.

Specific terms work better than “be respectful.” Write “dishes washed within 12 hours,” “quiet hours from 10 p.m. to 7 a.m.,” or “guest notice in the group chat by 6 p.m.” The point is clarity, not a 14-page constitution for the fridge.

Payments will use a method that creates a record. A roommate whose missed or failed payment causes a documented late charge or returned-payment fee will reimburse that actual charge, to the extent allowed by the lease and applicable law.

6. Security deposit and other move-in money

A deduction tied to one roommate, that person's guest, or that person's pet will be charged to that roommate when supported by the move-in record, photos, invoices, landlord statement, or other clear evidence. A deduction that cannot be assigned will be divided [equally / in these percentages].

7. Food, supplies, furniture, and personal property

8. Guests and gatherings

9. Noise, work, cleaning, and shared-space use

10. Pets, smoking, safety, and damage

Pets are [not allowed / allowed only as permitted by the lease and listed here: ___]. A pet's owner handles care, charges, cleanup, and documented damage caused by the animal. This pet section does not change any applicable rights or accommodation process for assistance animals.

Smoking and vaping are [prohibited / allowed only in this lease-permitted area: ___]. Roommates will follow the lease rules for candles, grills, and other fire risks.

Everyone will lock exterior doors and windows as agreed, protect keys and codes, and report loss promptly.

A roommate will promptly report a leak, pest issue, broken lock, missing alarm, or other repair or safety problem through [landlord's required channel]. A roommate responsible for damage beyond ordinary wear, including damage caused by a guest or pet, will pay the documented repair cost that the landlord or roommates actually incur.

11. Leaving early or replacing a roommate

A roommate planning to leave before the agreement ends will give the other roommates written notice at least [number] days before the proposed move-out date and give the landlord any separate notice the lease or law requires.

The departing roommate will [lead / share] the replacement search and remain responsible for their agreed costs until the earliest of the following, subject to the lease and applicable law:

  • the landlord releases that roommate in writing;
  • an approved replacement becomes responsible and starts paying under signed documents; or
  • the lease and this agreement end.

A proposed replacement must satisfy [lawful, objective household criteria], the landlord's lawful screening rules, and any lease requirements. Remaining roommates will approve or give a specific reason for declining within [number] days. No replacement may move in until every required lease amendment, assignment, sublease, or approval is signed.

The departing roommate will pay [the following actual transfer, screening, or replacement costs approved by the landlord: ___]. Before leaving, that roommate will remove belongings, clean assigned areas, return keys, provide a forwarding address, and sign a deposit and condition addendum with the remaining and incoming roommates.

12. Problems, changes, and copies

A roommate raising a nonemergency problem will describe it in the agreed written channel. Everyone will meet within [number] days and focus on the specific term and a workable fix. If the problem remains unresolved, the roommates will use [named campus service / community mediator / other neutral process] when available.

Nothing here permits a roommate to change locks, remove another person's belongings, shut off utilities, or use any other self-help remedy that the lease or law does not allow.

Changes to this agreement must be written and signed by everyone. The roommates will review it on [date, often 30 days after move-in] and then every [number] months or when rent, occupants, pets, or other material facts change. Each roommate receives the complete signed version.

Make the agreement usable after everyone signs

Set one short review about a month after move-in. That is enough time to learn that “weekly cleaning” means three different things, without waiting for the sink to become a personality test. Amend the agreement in writing when a roommate, rent share, pet, recurring bill, or bedroom assignment changes.

Avoid made-up punishments. Automatic fines, lockouts, property removal, and roommate-declared “eviction” rights can conflict with the lease or local law. A cleaner remedy is to assign actual documented costs, use the landlord's process for lease violations, and use a lawful replacement or move-out process.

Roommate agreement FAQs

Is a roommate agreement legally binding?

It can create a private contract among roommates, especially for clear financial promises such as rent shares, utility reimbursement, or responsibility for documented damage. Enforceability depends on the terms and applicable law. House rules still matter because they set expectations, even when a court cannot realistically supervise dishes or quiet hours.

The agreement does not bind the landlord or rewrite the lease. State and local rules also vary. USAGov's tenant-rights directory points renters to the relevant state agencies and legal-aid resources.

Does the landlord need to sign it?

A standard agreement among co-renters usually does not need the landlord's signature. The landlord must still approve and sign any occupancy change, lease amendment, assignment, or sublease when the lease or local law requires it. Keep those approvals with the roommate agreement.

Does a roommate agreement need to be notarized?

A signature and date from every roommate are the useful baseline. The current UT Austin Legal Services roommate contract calls for the roommates to execute the agreement and includes no separate witness or notary block. A notary verifies a signature; it does not repair a term that conflicts with the lease or law.

Can roommates sign an agreement after moving in?

Yes. Use current balances and responsibilities as the starting point, and state the effective date. Do not use a new agreement to invent retroactive charges. If money is already disputed, list the exact amount and resolution separately so no one mistakes it for an agreed fact.
