Price control generally applies to older multi-unit rentals. New construction built after January 1, 1983 is exempt from Oakland’s local rent rule. Building year and property size are only a first pass. State-law exemptions, owner occupancy, substantial rehabilitation, and other exemptions can matter.

Oakland’s just-cause rules cover most rentals, including many single-family homes, ADUs, and rented vehicular residential facilities. Measure V’s separate rolling exemption applies only to ground-up new construction that received a certificate of occupancy within the past 10 years. It does not apply to units created through rehabilitation, improvement, or conversion of existing space. A ground-up unit built after January 1, 1983 can remain exempt from local rent control after its 10-year just-cause exemption expires. $8,293.13–$12,599.18 by unit size. For notices served from July 1, 2026 through June 30, 2027, the published base schedule is $8,293.13 for a studio or one-bedroom unit, $10,206.93 for a two-bedroom unit, and $12,599.18 for a unit with three or more bedrooms. One $2,500 add-on may apply per unit for a qualifying household that includes a lower-income, elderly, or disabled tenant and/or a minor child. Multiple qualifying people or categories do not create multiple add-ons. This schedule can apply to specified displacement grounds such as an owner or qualifying-relative move-in, Ellis Act withdrawal, condominium conversion, and permanent code-compliance displacement. Temporary code-compliance displacement instead uses actual and reasonable moving and temporary-housing expenses. For an owner or qualifying-relative move-in, the base payment is tenure-phased: one-third for a tenancy under one year, two-thirds for a tenancy of at least one year but under two years, and the full base after two years.

One month’s rent in most cases under California law. A landlord that owns no more than two residential rental properties with no more than four total units offered for rent may charge up to two months only if the landlord is a natural person or an LLC whose members are all natural persons. A qualifying family trust can fall within this exception through the statute’s definition of a natural person, which includes a natural-person settlor or beneficiary. This small-landlord exception does not apply to a prospective service-member tenant. The deposit limit is separate from the first month’s rent. Oakland does not add a general local deposit-interest requirement. State deadlines and itemization rules still apply when a tenancy ends.
